California Proposition 65 compliance

What is Proposition 65?

California's Proposition 65 (CP65), also called the Safe Drinking Water and Toxic Enforcement Act, was enacted in 1986. It is intended to help Californians make informed decisions about protecting themselves from chemicals known to cause cancer, birth defects or other reproductive harm. A new amendment to the law (passed in 2016 and effective August 30, 2018) requires reasonable warnings as defined by the California Code of Regulators. This new amendment requires a warning label if two conditions are met: (1) the product contains one or more substances from a list of over 900 chemicals AND (2) there is a human exposure of concern above “safe harbour” levels (where applicable) resulting in potential reproductive or carcinogenic impact.  

What is Eaton doing to be compliant?

Consistent with our commitment to be active stewards of the environment, we provide products that are fully compliant with applicable regulations and standards. Products are designed for the environment and materials are selected based on industry-accepted codes and standards for product safety, integrity, quality and performance specifications. With respect to California Proposition 65, we have evaluated the relevant products and added warnings where appropriate and required. Furthermore, we track amendments and new entries to the above list of chemicals and take the necessary steps to ensure continued compliance with CP65 in a timely manner.

Where should the warning symbol appear?

The warning can appear on the product, packaging, within the manuals and other documentation and online websites. 

Does the law require warnings on e-commerce sites when commerce can be done or is done within California?

Yes, warnings should be provided on e-commerce sites, and Eaton will advise our distributor/resellers if a product requires a warning label.
